Renege? ‘Deed restrictions’ still apply even if they are not noted in the actual deed but are recorded by the register, in this case back in 1956. As long as the deed has a ‘subject to’ clause, a newly “discovered” encumbrance may be addressed prior to closing. It’s not unheard of.
