  • Renege? ‘Deed restrictions’ still apply even if they are not noted in the actual deed but are recorded by the register, in this case back in 1956. As long as the deed has a ‘subject to’ clause, a newly “discovered” encumbrance may be addressed prior to closing. It’s not unheard of. As per seeking remedies, because of the aforementioned and absent any fraud, I don’t see the city being liable. This is my understanding. Just let it go… https://vimeo.com/195192279
